The practice is to make a legal will which

Hello. I can see references in the Torah regarding inheritance. Seems that normally daughters do not receive any, if there is a son in he family. And, also, the oldest child gets a double portion. Are these ‘rules’ really represent currently binding mitzvah or are they just description of what ‘used to be’ ? Are we today supposed to follow this pattern of ‘distributing’ family inheritance , or are we ‘free’ to do that any other way through a legal Will or Trust ?

Shalom and thank you for your question!

The practice is to make a legal will which is halachically acceptable, by including a clause which indicates that the estate is given to those persons who are mentioned there, as a gift just before the owner of the estate (estate meaning all property and possessions), passes away. This enables one to bequeath his/her property to whom he/she chooses.

This should be done in consultation with a Rabbi and/or a lawyer who are familiar with Jewish law in this area.

Wishing you a good and sweet year!
