תנאי בהגרלה

עשו הגרלה על כרטיס טיסה בין תושבי המקום בתשלום, וזכה בו אחד שאינו תושב המקום, האם ניתן לעכב עליו את הזכייה, בטענה שלא היה לו זכות לקנות כרטיס?

  • תשובה

כל עוד לא היה תנאי מפורש, שההגרלה מיועדת אך ורק לתושבי המקום, אזי לא ניתן לעכב עליו את הזכייה, למרות הרגש של תושבי המקום נגד זכייתו.

מבואר בריבוי מקומות וכן נפסק להלכה, ש"כל תנאי שבממון קיים" (ראה למשל שו"ע אבן העזר קיא סעיף סז).


ולכן אם התנו מפורש שההגרלה מיועדת אך ורק לתושבי המקום, א"כ עבר על תנאי הגרלת הממון, ושיקר בדבר, ואין זכייתו נחשבת. אך אם אי"ז היה מתנאי ההגרלה, רק מצד רגש תושבי המקום, אין הם רואים זאת בעין יפה, אין להם אלא תרעומת, אך זכייתו נחשבת זכייה, ואינם יכולים להפקיע זאת ממנו.
